1. Acceptance of Terms
By accessing or using any service provided by HostKloud ("Company", "we", "us"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.
2. Services
HostKloud provides web hosting, cloud hosting, VPS hosting, WordPress hosting, and domain registration services. We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.
3. Account Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials.
- You must provide accurate and complete registration information.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately of any unauthorized use of your account.
4. Acceptable Use
You agree not to use our services to:
- Host, distribute, or transmit illegal, harmful, or offensive content.
- Send unsolicited bulk email (spam) or engage in phishing activities.
- Conduct denial-of-service attacks or attempt to compromise other systems.
- Violate any applicable local, national, or international law or regulation.
- Infringe on intellectual property rights of any third party.
Violation of this Acceptable Use Policy may result in immediate account suspension or termination without refund.
5. Billing & Payments
- All services are billed in advance on a monthly or annual basis.
- Prices are subject to change; you will be notified before your renewal date.
- Failure to pay may result in service suspension after a grace period.
- Suspended accounts are subject to data deletion after 14 days of non-payment.
6. Uptime & Service Levels
HostKloud aims to provide 99.9% network uptime. Scheduled maintenance windows are excluded from uptime calculations. We are not liable for downtime caused by factors outside our reasonable control, including but not limited to natural disasters, third-party network failures, or DDoS attacks.
7. Data & Backups
While HostKloud may perform regular backups, you are solely responsible for maintaining independent backups of your data. HostKloud is not liable for data loss under any circumstances.
8. Limitation of Liability
To the maximum extent permitted by law, HostKloud shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our services. Our total liability shall not exceed the amount paid by you in the 3 months prior to the claim.
9. Termination
Either party may terminate services with written notice. HostKloud may terminate accounts immediately for violations of these Terms. Upon termination, your data may be permanently deleted.
10. Governing Law
These Terms are governed by the laws of Bangladesh. Any disputes shall be resolved in the courts of Bangladesh.
11. Changes to Terms
We reserve the right to update these Terms at any time. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
